Welcome to Pushpa. These Terms of Service ("Terms") govern your use of the Pushpa mobile application and website (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Pushpa Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information

3. User Accounts

3.1 Account Registration

4. Use of Service

4.1 Ride Booking

Pushpa provides a platform to connect riders with drivers. We do not provide transportation services directly. The transportation services are provided by independent third-party drivers.

4.2 Fare Calculation

Fares are calculated based on distance, time, vehicle type, and other factors. The fare estimate provided before booking is an approximation and may vary based on actual route, traffic conditions, and other factors.

4.3 Payment

You agree to pay all charges incurred under your account. Payment methods include cash, digital wallets, and other payment options available in the app. All payments are final and non-refundable except as required by law.

5. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Harass, abuse, or harm drivers or other users
  • Provide false or misleading information
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service to transmit viruses, malware, or other harmful code
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems to access the Service without our permission

6. Driver Responsibilities

If you are a driver using the Pushpa platform:

  • You must have a valid driver's license and vehicle registration
  • You must maintain appropriate insurance coverage
  • You must comply with all traffic laws and regulations
  • You must provide safe and professional transportation services
  • You are an independent contractor, not an employee of Pushpa

7. Cancellation Policy

7.1 Rider Cancellation

Riders may cancel a ride before the driver arrives. Cancellation fees may apply if the cancellation occurs after a certain time period or if the driver has already arrived at the pickup location.

7.2 Driver Cancellation

Drivers may cancel a ride if the rider is not present at the pickup location within a reasonable time or for other valid reasons.

8. Safety and Security

Your safety is our priority. We implement various safety features including:

  • Driver background verification
  • Real-time ride tracking
  • Emergency SOS button
  • Ride sharing with trusted contacts
  • 24/7 customer support

9. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Pushpa and are protected by copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, Pushpa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code that may be transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

11. Indemnification

You agree to indemnify, defend, and hold harmless Pushpa, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

15. Severability
